General Terms & Conditions

All rights, obligations, specials, orders and agreements that fall under these General Terms and Conditions, and under this condition, are applicable under Dutch Law and Jurisdiction. In the case of translation or explanation of the contents of Little Boomerang's website, the original version of the text in this website and these General Terms and Conditions will remain determinate.

1. General
These conditions apply to all sales and agreements between Little Boomerang and the consumer, whereby Little Boomerang will apply these conditions unless agreed otherwise in writing. If articles are ordered from Little Boomerang, the purchaser automatically accepts the stipulations set out in these General Terms and Conditions.

2. Orders
By placing an order with Little Boomerang, customers are (i) offering to purchase a product, (ii) representing that they are of legal age to form a binding contract, and (iii) representing that all information they provide to Little Boomerang in connection with such order is true and accurate and that they are an authorized user of the payment method provided. The receipt of an order confirmation does not constitute Little Boomerang's acceptance of an order. Little Boomerang retains the right to refuse any request made by any customer.

Once an order has been placed, the customer will directly receive an email to confirm the details of the order and the total costs associated with the order.

All orders will be sent within five working days after receipt of payment by the consumer. Custom made orders placed will be sent within 4-6 weeks working days after receipt of the preloved shirt from the consumer since they are handmade-to-order.

If Little Boomerang fails to comply with this, the consumer may immediately break the order contract. This is not possible, however, if the parties involved have previously agreed to a different delivery term.

The information on our website is up-to-date, however, the possibility remains that a certain product cannot be delivered or made. We will inform the customer as soon as possible.

3. Prices and Payment
All prices indicated on Little Boomerang's website are in Euro’s and include value added tax. Customers are able to make payments electronically to Little Boomerang via Apple Pay, IDEAL or Pay Pal. The different payment methods are indicated on the website.

4. Delivery
The delivery time is indicative and is therefore not guaranteed. Little Boomerang cannot be held responsible if the post is unable to deliver the order to the consumer on time.

5. Returns
If the customer, for whatever reason, does not wish to keep the product, the consumer has the right to return the product to Little Boomerang within fourteen days after receiving the product. Custom made  items cannot be returned or refunded.

All items must be returned in their original packaging and with the original hangtags. Little Boomerang will not accept any items that have been washed, worn, stained, damaged or altered in any way. Items that do not meet these conditions will be returned to the sender, minus the shipping costs for returning the items. 

Exchanging an item is not possible. In that case the order will be refunded, any new items can be bought in the online store.

All returns should be requested by sending an email with all necessary information (name, order number and reason of return) to hello@littleboomerang.nl. Items sent back to us without first requesting a return will not be accepted. Returns will be handled within 5 working days from receiving the return. The returned items will be refunded to the same card or account that they were paid from. Shipping costs will not be refunded.

Shipping costs for returning are the responsibility of the customer. We cannot be held responsible for anything lost or damaged in return transit.

6. Transfer of Ownership
Ownership of merchandise will not be transferred until the associated obligations of purchaser have been fulfilled. At the point of transfer of ownership, which is at the point of delivery of the articles, product liability is transferred to the purchaser.

7. Money Back Guarantee
If the customer, for whatever reason, does not wish to retain the article, the consumer has the right to return the article to Little Boomerang within fourteen working days after taking delivery of the article. The customer must first inform Little Boomerang in writing via email of their intention, and must follow all further return conditions and instructions stipulated by Little Boomerang. This guarantee does not comply if the article has been worn or washed, or if the consumer has attempted to mend or alter the article in any way.

Return articles will only be accepted if it is sent in the original, undamaged wrapping and the labels are still attached to the item(s). Furthermore, the shipping costs of the returned merchandise will be entirely paid for by the consumer. Under no circumstances will Little Boomerang reimburse the shipping costs of returned merchandise. If the return instructions have been followed accurately, Little Boomerang will reimburse the customer for the returned item(s) within thirty days after receiving it.

8. Queries/ Complaints
In the case of queries or complaints concerning any of our products or procedures, please inform us by email at hello@littleboomerang.nl.

9. Privacy
Little Boomerang finds it very important to ensure that all of the consumer’s personal information is treated with the utmost care and security. Little Boomerang will not give the consumer’s personal information to third parties, except when the information is required for the delivery of the order. When making an order, Little Boomerang requires the customer’s name, invoice and delivery addresses, and payment details so that an order can be processed. The payment details will only be used to conclude the payment process.

If the consumer subscribes to our newsletter or RSS, their personal details will be used to keep them informed of changes to our assortment, special offers, website improvements and other relevant information.

Little Boomerang records of website visits are kept for statistical purposes. Information concerning the amount of visitors and visitor frequency to our website will be used for internal research and website improvement. However, this general information is anonymous and cannot be traced back to the individual visitor.

10. Liability
All Little Boomerang products are made with care. Little Boomerang cannot assume any liability for damages in any form whatsoever, physical, material or immaterial, that can be caused by malfunctioning or ill use of the products.

Custom made orders
All preloved shirts send to us should not be worn out, but should be clean, undamaged and free from stains and tears. Little Boomerang is not responsible for any damages that may occur during the production of a custom made item. Little Boomerang aims to upcycle the customers preloved shirt into one of the custom designs but cannot derive any rights from the final custom made product. Slight differences may occur due to the features and/or defects of the preloved shirt.

Website
The content of the website has been compiled with the greatest care. But Little Boomerang cannot preclude the possibility of any error or incompletes in the information on their website. And cannot be held responsible for any typing or misprinting errors that could communicate an incorrect selling price. In that case Little Boomerang will adjust the price as soon as possible.

The images of the fabrics have been made as matching as possible, but there might be slight differences in the indicated colors or patterns of the actual products.

Certain links on the website can give access to websites and information that is being exploited and maintained by third parties. Little Boomerang does not control these sites and it not responsible for the content of these sites.

11. Force Majeure
Despite any other established legal rights, Little Boomerang is entitled, at its own choice, in case of Force Majeure, to cancel your order, or cancel the purchase agreement without legal intervention, by informing the client in writing. Client is not entitled to any damages, unless given the circumstances this would be unacceptable according to measures of reason and fairness.

12. Copyright
All information on Little Boomerang’s websites is protected by copyright. It is illegal to copy, use or distribute any information from Little Boomerangs’ website without first acquiring written permission. Visitors and users of Little Boomerang’s website may not claim any rights pertaining to the information on the website. None of the text or graphics from Little Boomerang’s websites may be partially or wholly copied or publicly used for printing, photocopying, faxing, overtyping, in an electronic database, or for any other reproduction purposes.

13. Acceptance of General Conditions
All website users are required to be aware of, and to agree with, all of the above General Conditions. By placing an order with Little Boomerang, the consumer automatically agrees to all of our General Conditions. Little Boomerang’s client’s details are automatically stored in our client list and will receive our newsletter.
